These terms apply to your use of functionised.com and the tools, downloads and messages we offer through it. functionised.com is operated by Functionised LLC (“Functionised”, “we”, “us”), 8 Merchants Way, Colts Neck, NJ 07722. By using the site you agree to these terms. If you do not agree, please do not use the site. Our Privacy Policy explains how we handle personal information.
1. Education, not medical advice
Everything on this site, including articles, videos, guides, the assessment, projections and simulated images, is general education. It is not medical advice, it does not diagnose or treat any condition, and it does not create a provider-patient relationship. A provider-patient relationship begins only when you are seen by one of our licensed providers and agree to care. Talk with your own licensed healthcare provider before starting any weight-management, exercise, nutrition or supplement program, especially if you are pregnant, take medication or have a medical condition.
In an emergency, call 911. Do not use our forms, chat, email or text messages for urgent or emergency needs. We may not see them right away.
2. The assessment and projection
The assessment is educational. It is not medical advice, it does not diagnose any condition, and its projections are illustrative ranges based on general population data, not a prediction or promise of your results. Your answers are self-reported; the result is only as accurate as the answers you give. Individual results vary.
3. Photo preview tool
This tool is not live yet. These terms apply from the day it launches. If you use the photo preview tool, you agree that:
- you are 18 or older;
- the photo is of you, you have the right to use it, and it shows no one else;
- you will not upload nude or sexual images, or images of anyone under 18;
- the output is a simulated image for illustration only. It is not a prediction, promise, or medical assessment, and individual results vary;
- we may refuse or stop any request, and we limit the number of images per visit.
How photos are processed, deleted within 24 hours and never used for training is set out in section 6 of our Privacy Policy. You keep all rights in your photo. You give us and our image-processing provider only the limited permission needed to create your simulated image and show it to you.
4. Text-message and email programs
- Text messages from Functionised: if you opt in, we may text you about your enquiry, appointments, guides you requested and, if you agreed to marketing texts, offers and news. Message frequency varies. Message and data rates may apply. Reply STOP to cancel at any time; reply HELP for help, or call 848-301-1515. Consent to texts is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages.
- Email: you can unsubscribe from marketing email at any time with the link in any message.
5. Guides, books and downloads
Free guides and downloads are for your personal, non-commercial use. Please do not resell, republish or share them publicly. Book excerpts are provided with the permission of their authors and remain their copyright.
6. Services, prices and appointments
Service descriptions on this site are general. What is right for you is decided at your consult or visit, where we explain any costs before you agree to them. Where a price is not shown, pricing is given at your consult. Insurance coverage for chiropractic care depends on your plan; please call to confirm. We ask for 24 hours’ notice to cancel or reschedule an appointment. Offers shown on the site are subject to the terms stated with them and may end at any time.
7. Our content and trademarks
The site’s text, images, videos, logos and design belong to Functionised or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal use. “The Biohacking Mecca” is a registered trademark of Functionised LLC (U.S. Reg. No. 6972587). FIT Clinic, FIT Lab, FIT Stretch and Live #Functionised are trademarks of Functionised. Other names and logos, such as ARX and FIT 3D, belong to their owners and are used only to describe the equipment we use.
8. Acceptable use
Please do not: use the site for anything unlawful; send us someone else’s personal information without their permission; try to break, overload, scrape or probe the site or its security; upload malicious code; impersonate anyone; or use the site’s content to train artificial-intelligence models for commercial products without our written permission. (Search engines and AI assistants may read and cite our public pages as our robots.txt allows.)
9. What you send us
You are responsible for the accuracy of what you submit. Please do not send detailed medical records or payment card numbers through the website. If you send us comments, reviews or suggestions, we may use them to improve our services without owing you anything, and we will not publish your name or a review you send us without your permission.
10. Links to other sites
We link to other websites, such as booking pages, Zocdoc, Google, YouTube, Amazon and social networks. We are not responsible for their content or practices, and their terms apply when you use them.
11. Disclaimers
We work to keep the site accurate and available, but it is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise that the site will be uninterrupted or error-free. Nothing in these terms limits any warranty or right that cannot be limited under New Jersey law, and nothing here changes the professional standards that apply to care you receive from our licensed providers.
12. Limitation of liability
To the fullest extent the law allows, Functionised and its owners, providers and staff are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the website, its content or its tools, and our total liability for any claim about the website is limited to one hundred U.S. dollars. This section does not apply to claims about care you receive from our licensed providers, or to liability that cannot be limited by law.
13. Your responsibility to us
If you misuse the site or break these terms, and that causes a claim against us, you agree to cover our reasonable costs of that claim, to the extent the law allows.
14. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute about these terms or the website will be brought in the state or federal courts serving Monmouth County, New Jersey, and you and we consent to their jurisdiction.
15. Changes
We may update these terms and will change the effective date above when we do. Changes apply from that date to your future use of the site.
