This policy explains, in plain language, what personal information Functionised collects through this website and our marketing messages, why, who helps us handle it, and the choices you have. functionised.com is operated by Functionised LLC (“Functionised”, “we”, “us”), 8 Merchants Way, Colts Neck, NJ 07722. It is written to match what we actually do. If something here stops being true, we change this page and the date above.
The short version
- We collect what you type into our forms, chat, assessment and messages, plus basic analytics about how the site is used.
- We use it to reply to you, schedule visits, send what you asked for, and improve the site.
- We do not sell your personal information. We do not share your mobile number or text-message consent with anyone for their own marketing.
- Email and text messages each need their own consent. Reply STOP to any text, or use the unsubscribe link in any email.
- If you become a patient, your health records are protected under HIPAA and described in our Notice of Privacy Practices, not this policy.
1. Who this policy covers
This policy covers visitors to functionised.com, people who contact us, and people who sign up for our emails, text messages, guides, assessment or tools. It does not cover patient health information created or received when you receive care at FIT Clinic. That information is protected under the federal HIPAA rules and handled as described in our Notice of Privacy Practices. Clinical services at FIT Clinic are provided by Dr. Michael Brandon LLC d/b/a Functionised.
2. What we collect
Information you give us
- Contact and booking forms, chat and calendars: your name, email address, mobile number, the service or concern you are asking about, preferred times, and anything you choose to add.
- Consent choices: whether you agreed to receive marketing email and, separately, marketing text messages, and when.
- Messages: texts, emails, chat messages and voicemails you send us, and notes our team makes to follow up with you. Calls to 848-301-1515 may be answered by our answering service, which takes a message for our team.
- Guide and download requests: the guide or book you asked for and the details needed to send it.
- Our assessment (if you take it): your self-reported answers about your goals and habits, for example goal, eating and activity habits, sleep, stress, age range, sex, height, weight, timeline, and whether you currently use a prescribed weight-management medication. The assessment is educational. It is not a medical service and not a diagnosis. See section 5.
- Photo preview tool (if you use it): one photo you upload. See section 6 for the special rules that apply to photos.
Information collected automatically
- Analytics: pages viewed, buttons tapped, the site that referred you, and general device, browser and approximate (city-level) location information. Analytics does not receive what you type into a form, your assessment answers linked to your name, email or phone, or any photo.
- Security and hosting logs: IP address, browser type and request times, used to keep the site secure and working.
- Cookies and similar technologies: see section 7.
We do not ask for, and ask you not to send through the website, detailed medical records, insurance ID numbers or payment card numbers. If you are already a patient and need to discuss your care, call us at 848-301-1515.
3. How we use it
- To reply to you, schedule and remind you about appointments, and follow up on your enquiry.
- To send the guide, results summary or information you asked for.
- To send marketing emails if you agreed to email, and marketing texts if you separately agreed to texts.
- To understand which pages and features are useful and fix the ones that are not.
- To keep the site, our systems and our visitors secure, and to prevent spam and abuse.
- To meet legal obligations and enforce our Terms of Use.
We do not use your information to make decisions that have legal or similarly significant effects about you by automated means alone.
4. Who we share it with
We do not sell personal information, and we do not share it with other companies for their own marketing. We share it only with service providers that help us run our business and are allowed to use it only for that purpose:
- GoHighLevel (LeadConnector): our contact, messaging, forms, chat and scheduling system. Your form entries, consent choices, assessment results and messages are stored there.
- Google: Google Analytics and Google Tag Manager (site analytics), reCAPTCHA (spam protection), Google Maps and YouTube embeds, and our email providers.
- Our website host and security tools: Hostinger (hosting, content delivery and caching), Wordfence and LiteSpeed.
- Our answering service, which takes messages when our team cannot pick up.
- Text-message and email delivery carriers used by GoHighLevel to deliver the messages you asked for.
- The image-processing provider for the photo preview tool, only if you use it (section 6).
We may also disclose information if the law requires it, to protect the rights, safety or property of our patients, visitors, staff or others, or as part of a sale, merger or reorganization of our business, in which case the new owner must honor this policy for the information we transfer.
Text messaging: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging opt-in data and consent are not shared with any third party, except the providers that deliver our messages.
5. The assessment and results
If you take our assessment, your answers are used to show you an educational result (a “pattern”) and an illustrative range, never a prediction or promise of your results. You can see your result without giving us any contact details. If you choose to have your full report sent to you, we save your answers, your result and your contact details in our contact system so we can send it and follow up, and you choose separately whether we may email you and whether we may text you. If you do not submit your contact details, your answers are not saved to our contact system. We may record anonymous analytics events, such as “assessment started” or “assessment completed” and the result pattern, without your name, email or phone number.
Because some assessment answers relate to health, we ask for your express consent before saving them, and we use them only to send your report, tailor the information we send you, and prepare for a consult you request. You can ask us to delete them at any time (section 9).
6. Photo preview tool
This tool is not live yet. These rules will apply from the day it launches, and we will name the provider here before then. The photo preview tool lets you see an illustrative, simulated image of yourself at a goal you choose. It is a curiosity tool: educational, not a medical service, not a diagnosis and not a prediction of your results.
- Adults only. You must be 18 or older and confirm it before uploading. Upload only a photo of yourself. Do not upload photos of anyone else or of anyone under 18. Photos showing nudity are refused.
- Your consent first. We ask for your consent before you upload, and you can stop at any time.
- Who processes it. Your photo is sent to a third-party image-processing provider, which creates the simulated image following our instructions and is not allowed to use your photo for any other purpose.
- Deleted within 24 hours. Your original photo and the simulated image are deleted automatically within 24 hours of upload, from our systems and the provider’s. We keep a record that the deletion happened, not the image.
- Never stored in our contact system. Photos and simulated images are never saved to GoHighLevel or attached to your contact record.
- Never used for training. Your photo and the simulated image are never used to train artificial-intelligence models, by us or by the provider.
- No biometric identification. We do not use your photo to identify you, and we do not create or keep face geometry or other biometric identifiers.
- Labelled. Every simulated image carries the label “Simulated image for illustration only. Not a prediction, promise, or medical assessment. Individual results vary.”
7. Cookies, analytics and similar technologies
Cookies are small files a website stores in your browser. We group them into:
- Strictly necessary: needed for security, spam protection, forms and remembering your cookie choice. These are always on.
- Analytics: help us count visits and see which pages and buttons are used.
- Advertising: let an advertising platform measure visits from its ads. functionised.com does not currently run an advertising pixel. If we add one, it will load only after you accept advertising cookies, and never on our assessment, booking, form or photo-tool pages.

Your choices. You can block or delete cookies in your browser’s privacy settings, and you can turn off Google Analytics on every site with Google’s Google Analytics opt-out add-on. A cookie-choice banner is being added to this site; when it is live, this section will describe it. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of any sale or targeted-advertising use of your information (we do neither today).
Our site does not change its behavior in response to “Do Not Track” browser signals, because there is no common standard for them; we honor Global Privacy Control as described above.
8. Email and text messages
- Separate consent. Email and text messages each need their own consent, given by a checkbox that is never pre-ticked. Agreeing to texts is never a condition of buying anything or booking a visit.
- Texts: message frequency varies. Message and data rates may apply. Reply STOP to stop, or HELP for help. After STOP, we send one confirmation and nothing else unless you opt in again. Appointment confirmations and reminders you request are sent as part of scheduling your visit.
- Email: every marketing email has an unsubscribe link and our postal address. We honor unsubscribes promptly.
- Marketing texts are scheduled for daytime hours, and we honor do-not-contact requests across every channel.
9. Your choices and rights
Wherever you live, you can ask us to:
- tell you what personal information we hold about you and give you a copy;
- correct it;
- delete it (we may keep what the law requires us to keep, and a minimal record that you asked us not to contact you);
- stop marketing to you by email, text or phone;
- withdraw any consent you gave, including for your assessment answers.
New Jersey residents have these rights under the New Jersey Data Privacy Act where it applies, as well as the right to opt out of the sale of personal information, targeted advertising and profiling. We do not sell personal information or use it for profiling that produces legal or similarly significant effects. To make a request, email support@functionised.com or call 848-301-1515. We will confirm your request, may need to verify your identity, and will respond within 45 days. If we decline, we will explain why and how you can appeal by replying to our decision; if you are not satisfied with the appeal, you may contact the New Jersey Division of Consumer Affairs. An authorized agent may make a request on your behalf with your written permission.
Requests about patient health records (copies, corrections and the other HIPAA rights) follow our Notice of Privacy Practices.
10. How long we keep it
- Contact records, messages and assessment results: while we have an active relationship with you and as long as needed for the purposes above, then deleted or de-identified. You can ask us to delete them sooner.
- Consent and opt-out records: kept as long as needed to prove consent and honor your choices.
- Photos and simulated images: deleted within 24 hours.
- Analytics: kept under the retention settings of our Google Analytics account, in aggregate reports.
- Patient records: kept as New Jersey law requires for health records, as described in our Notice of Privacy Practices.
11. Security
We protect information with encrypted connections (HTTPS), access limited to staff who need it, and security monitoring. No system is perfectly secure; if we learn of a breach that affects your personal information, we will notify you as the law requires.
12. Children
This website is intended for adults, including parents or guardians contacting us about a child. We do not knowingly collect personal information online from children under 13, and the assessment and photo preview tool are for adults 18 and older. If you believe a child has sent us information, contact us and we will delete it.
13. Other websites
Our pages link to other sites, including fitclinic.co, our booking pages on functionised.net, Zocdoc, Google, YouTube, Amazon and social networks. Their own privacy policies apply when you use them.
14. Changes to this policy
We will update this page when our practices change and change the effective date at the top. If a change materially affects how we use information we already hold, we will ask for your consent where the law requires it.
